Employer Intentional Tort

An employer intentional tort may occur when an employee is injured because they were required to work in a job position or job situation that is so dangerous that injury or sickness is substantially certain to occur. The employer must:

(1) have knowledge of the dangerous condition;

(2) allow the dangerous condition to continue to exist after it is known to them; and.

(3) must require the employee to work in the dangerous condition.

An employee may be able recover all reasonably provable tort damages for such claims, including lost pay, pain and suffering, as well as punitive damages and attorneys fees and costs (if punitive damages are obtained). The damages for the claim are subject, however, to being attached by the Workers Compensation system in an amount equal to what has and will be paid by that system.

FMLA

The Family Medical Leave Act (“FMLA”) entitles certain employees to a total of twelve (12) weeks of unpaid leave from work. The FMLA also requires an employer to restore an employee returning from FMLA leave to his or her prior position. As a general rule, unless the FMLA protects your absence, there is no other protection available for absences from work, even those resulting from workplace-caused injuries or conditions.

Probate & Estate Administration

Retaliatory Discharge

The most common forms of unlawful retaliatory discharge may occur when an employee:

(1) is discharged for filing a Charge of Discrimination with the Ohio Civil Rights Commission (“OCRC”) and/or the Equal Employment Opportunities Commission (“EEOC”);

(2) is discharged for reasonable complaints of unlawful workplace discrimination and/or harassment (generally regarding age, race, gender, disability, national origin, or religion);

(3) is discharged for making reasonable complaints about job safety issues, or filing a complaint with the Occupational Safety and Health Administration (“OSHA”); or,

(4) is discharged for reasonable complaints of unlawful behavior by the employer, or for refusing to comply with an employer’s order to perform an unlawful act.

Such claims can generally recover all available damages, including lost pay and benefits, pain and suffering, as well as punitive damages and attorneys fees and costs.
